Abstract

This study examines the legal politics underlying the formation of Indonesia’s Job Creation Law by analyzing the relationship between political configuration and the character of the resulting legal product. It employed normative legal research using statutory, conceptual, and historical approaches, with legislation, Constitutional Court decisions, legislative documents, official materials, and relevant scholarly literature as the principal legal materials. The materials were analyzed qualitatively through descriptive-analytical and prescriptive legal reasoning. The findings show that strong executive policy leadership, broad legislative support, accelerated regulatory reform, and an economic agenda focused on investment facilitation, regulatory simplification, employment creation, and competitiveness significantly influenced the formation and orientation of the Job Creation Law. The resulting legal product demonstrates a strong instrumental-economic character, while combining responsive elements in addressing regulatory fragmentation and administrative inefficiency with conservative tendencies concerning legislative deliberation, meaningful public participation, and the distribution of protected interests. Constitutional Court Decision Number 91/PUU-XVIII/2020 functioned as an important corrective mechanism by affirming that political legitimacy must remain subject to constitutional procedures, openness, and meaningful participation. The study concludes that the character of legislation is shaped by the interaction between political power, legislative procedures, substantive regulatory orientation, public participation, administrative safeguards, and constitutional control.
